Suspension of obligations to declare, concerning the posting of workers and the control of compliance with Luxemburgish minimum wage regulations applied to posted hauliers in the context of the cross-border transport of goods and persons

The regulations governing the posting of workers in relation to the provision of services are, in principle, applicable to situations concerning the transport of goods and persons for:

  • cabotage operations within Luxembourg
  • cross-border transport from and to Luxembourg

Currently, however, the obligations to declare, in respect of the posting of workers and the control of compliance with Luxemburgish minimum wage regulations applied to posted hauliers in the context of cross-border transport of goods and persons, as well as cabotage operations within Luxembourg, are suspended. The reason being that the outcome of the discussions held on the European level, on the European Commission’s proposal for a directive concerning the determination of specific rules to govern the posting of hauliers in the road transport sector, is still outstanding. The above-mentioned posting provisions for the road transport sector are suspended until the transposition of the specific rules into national law.
